Well, I know that; the reality of the situation is that he pulled out without checking for traffic. However, I had at the back of my mind the general rule about the person driving into the other car being at fault and technically my car did go into his. I suppose it would have been possible to argue that I should have been travelling slow enough to brake in such an eventuality. And, at the end of the day, it would have been his word against mine so an unprincipled cad might have thought it worth arguing the toss.

You should always drive assuming everyone else on the road is an idiot. In theory I could argue that in a filter lane you shouldn't be going so fast you can't do something about someone jumping in front of you (or a pedestrian weaving in-between stationary traffic).
